Fatal accident claims are always sad no matter how or why the accident happened.

There will be a claim on behalf of the deceased’s estate.  This might include a claim for pain and suffering, but often it is limited to the costs incurred due to their death – funeral expenses and so on.

There may be dependents who are entitled to make a claim.  A limited number of people can claim a bereavement award of £12,980, (from 1st May 2020 this sum is £15,120) though this is cold comfort.  More important is ,the loss of the money that the deceased would have contributed to their loved ones.  That and the loss of the help or services they would have provided around the house.

It is important to appreciate that money in no way compensates for losing someone.  What it does is make it slightly easier for those who are left behind to live a life with less financial struggle.

Inquests quite often play their part and we can also assist with these if it is needed.  An inquest’s function is to explore how a person came to die, not to point the finger or lay blame anywhere, but the evidence gathered in during this process can help in the main claim.

An inquest and a claim can to an extent serve the same purpose - to find out what happened. Often the documents or evidence that is gathered for an inquest does not go far enough, and with our experience we can help the Coroner obtain other evidence that will inform their final verdict.
